2. Purpose

These Terms & Conditions govern the usage of the diginetic.it website (hereinafter “the Website”) and the Sofia service (System Optimised for Intelligent Administrative Functions), an AI assistant for legal knowledge management.

Access to and usage of the Website and the Sofia service imply full acceptance of the Terms & Conditions. If you do not accept these terms, please do not use the Website or the service.

3. Terms of Use of the Website

3.1 Access to the Website

Access to the public pages of the Website is free of charge and does not require any registration. Access to the Client Area and the service requires the creation of an account with an email address and password, and the mandatory configuration of two-factor authentication via an authentication app (TOTP one-time code); no telephone number is required or used. Access to the service is subject to the approval of an access request by the Data Controller, or to the redemption of an invitation.

3.2 Permitted Use

You undertake to use the Website and the Sofia service exclusively for:

  • Lawful purposes in accordance with current legislation
  • Professional activities in the public administration and legal sectors
  • Consultation of regulatory and case-law information

3.3 Prohibited Use

The following is expressly prohibited:

  • Usage of the service for unlawful activities or activities contrary to public order
  • Infringement of third-party intellectual property rights
  • Attempting to gain unauthorised access to computer systems
  • Spreading viruses, malware or malicious code
  • Usage of bots, scrapers or automated systems without authorisation
  • Reselling or sub-licensing access to the Sofia service without written authorisation

4. Intellectual Property

4.1 Rights relating to the Website

All content on the Website (text, images, graphics, logos, software, design) is the exclusive property of Ge.Co. sas or the respective owners and is protected by copyright and industrial property laws.

4.2 Trade Marks

Diginetic and Sofia are trademarks of Ge.Co. sas. Unauthorised use of these trademarks is prohibited.

4.3 Licence of Use

You are granted a non-exclusive, non-transferable and revocable licence to use the Sofia service solely for the professional purposes for which it was subscribed to. All other rights are reserved.

5. Limitations of Liability

5.1 Nature of the Service

Important Disclaimer: Sofia is an artificial intelligence-based decision-support tool. The answers provided are for information purposes only and do not constitute binding legal advice. The user is always responsible for verifying the information and making the final decision.

5.2 Exclusion of Warranties

Ge.Co. sas does not guarantee:

  • The accuracy, completeness or timeliness of the information provided by Sofia
  • The absence of errors, interruptions or malfunctions in the service
  • Continuous and uninterrupted availability of the service (99.5% SLA, excluding scheduled maintenance)

5.3 Limitation of Liability

Ge.Co. sas is not liable for:

  • Direct or indirect damages arising from the use (or inability to use) of the service
  • Decisions made by the user on the basis of the information provided by Sofia
  • Service interruptions due to force majeure or maintenance
  • Loss of data not attributable to wilful misconduct or gross negligence on the part of Ge.Co. sas

6. External Links

The Website may contain links to third-party websites. Ge.Co. sas does not control and is not responsible for the content, privacy policies or practices of such external sites. Access to third-party websites is at the user’s sole responsibility.

7. Suspension and Termination

Ge.Co. sas reserves the right to suspend or revoke access to the Sofia service in the event of:

  • Breach of these Terms & Conditions
  • Misuse or fraudulent use of the service
  • Non-payment (for any paid services)
  • Request from the Judicial Authority

8. Changes to the Service

Ge.Co. sas reserves the right to modify, suspend or discontinue, temporarily or permanently, the Sofia service (or any part thereof) at any time, with or without notice.

9. Governing Law and Jurisdiction

These Terms & Conditions are governed by Italian law.

Any dispute relating to the interpretation, validity and enforcement of these Terms & Conditions shall fall within the exclusive jurisdiction of the Court of Terni, unless otherwise required by mandatory legislation.

10. Regulatory Compliance

10.1 AI Act (EU Regulation 2024/1689)

Sofia is classified as a low-risk AI system under the AI Act. Ge.Co. sas guarantees:

  • Transparency: the user is always informed that they are interacting with an AI system
  • Traceability: every response includes verifiable citations
  • Human supervision: Sofia is a support tool, not an autonomous decision-maker
  • Technical documentation available on request for public bodies

10.2 GDPR (EU Regulation 2016/679)

The processing of personal data is governed by the Privacy Policy and the Cookie Policy published on the Website.

11. Amendments to the Terms & Conditions

Ge.Co. sas reserves the right to amend these Terms & Conditions at any time. Any amendments will be published on this page, indicating the date of the last update. Continued use of the Website following the publication of any amendments constitutes acceptance of the new terms.
